Movement of Unreleased Air Cargo
Customs Notice 16-15

1. This notice provides new policy information regarding the re-manifesting requirements of unreleased air cargo.
2. Effective immediately, the Canada Border Services Agency (CBSA) will allow unreleased air cargo to move on the original manifest from the first point of arrival (FPOA), to the stated destination primary warehouse that is licensed to receive air shipments (as indicated on the manifest), without a re-manifest. Please refer to Memorandum D4-1-4 for additional information on warehouse types.
3. Liability for duties and taxes on the unreleased goods will remain with the bonded carrier associated with the cargo control number (CCN) on the manifest, regardless of the carrier that physically transports the goods.
Example:
- An air cargo transmission has been sent by a bonded air carrier showing a destination of Montréal-Pierre Elliott Trudeau Airport, and a port of report of John C. Munro Hamilton International Airport. Note: It is important to note that although the cargo will physically be discharged in Hamilton, in order for release to take effect at destination, Montréal-Pierre Elliott Trudeau Airport must be provided within the port of discharge field.
- The cargo arrives by aircraft at the Hamilton International Airport (FPOA). A Conveyance Arrival Certification Message (CACM) is sent by the transporting carrier.
- The cargo is moved onto a truck at the Hamilton International Airport, and transported to Montréal-Pierre Elliott Trudeau Airport by a highway carrier (bonded or non-bonded).
- The primary warehouse at the Montréal-Pierre Elliott Trudeau Airport sends a Warehouse Arrival Certification Message (WACM) which arrives the cargo. A release is on file and in good standing. The cargo is released and may be picked up from the primary warehouse.
Note: No re-manifest is required by the highway carrier. Liability for duties and taxes remains with the air carrier until the cargo is arrived at the primary warehouse at the Montréal-Pierre Elliott Trudeau Airport.
4. Cargo tracers, if required, and any penalties for cargo infractions, will be issued against the carrier associated with the CCN on the manifest.
5. A re-manifest will continue to be required:
- (a) to change the destination of the cargo from what was originally reported on the manifest; or,
- (b) to transfer the liability for duties and taxes of the cargo to another bonded carrier; or,
- (c) to split the shipment into two or more shipments for furtherance.
6. This new policy will be included in the next updates to Memorandum D3-2-1, and Chapter 2 of the Electronic Commerce Client Requirements Document (ECCRD), Advance Commercial Information (ACI) Air.
