Amendment to the Delegation of the Powers, Duties, and Functions of the President of the Canada Border Services Agency and Designation of Officers under the Customs Act

This document amends the Delegation of the Powers, Duties, and Functions of the President of the Canada Border Services Agency and Designation of Officers under the Customs Act Document signed on , and subsequently amended, as per the attached Schedule for the purpose of items 42(2), 42.01, 42.1(1), 42.1(1.1), 58(1), 59(1), 59(1)(a)(ii), 97.201(2) and 97.201(4).

This document comes into force on the date it is signed.

The regional positions of Auditor, Senior Regional Auditor and Manager (CT-EAV-04) are added to the following designations and delegations:

42(2) Authority to perform inspections for any purpose related to the administration or enforcement of the Customs Act as described under paragraphs 42(2)(a) to (d).
42.01 Authority to conduct a verification of origin (other than a verification of origin referred to in section 42.1), verification of tariff classification or verification of value for duty in respect of imported goods; and enter any prescribed premises for that purpose.
42.1(1) Authority to conduct a verification of origin of goods for which preferential tariff treatment under a free trade agreement, other than CEFTA, CUFTA or CETA, is claimed; and enter any prescribed premises or place at any reasonable time to verify the amount, if any, of matters described under sub-paragraphs 42.1(1)(b) (i) or (ii).
42.1(1.1) Authority to conduct a verification of origin of goods for which preferential tariff treatment under the CEFTA, CUFTA or CETA is claimed.
58(1) Authority to determine the origin, tariff classification and value for duty of imported goods at or before the time they are accounted for under subsection 32(1), (3) or (5), excluding goods involving a tariff classification under tariff item No. 9899.00.00 in the List of Tariff Provisions set out in the Schedule to the Customs Tariff.
59(1) Authority to re-determine the origin, tariff classification, value for duty or marking determination of any imported goods in the case of a determination under section 58, excluding goods involving a tariff classification under tariff item No. 9899.00.00 in the List of Tariff Provisions set out in the Schedule to the Customs Tariff.
59(1)(a)(ii) Authority to re-determine the origin, tariff classification, value for duty or marking determination of any imported goods at any time within four years after the date of the determination, excluding goods involving a tariff classification under tariff item No. 9899.00.00 in the List of Tariff Provisions set out in the Schedule to the Customs Tariff.
97.201(2) Authority to conduct a verification of origin of goods on behalf of the CEFTA state to which the goods were exported, on behalf of Ukraine or on behalf of an EU country or other CETA beneficiary to which the goods were exported; and enter any prescribed premises or place at any reasonable time to verify the goods are originating within the meaning of Annex C of CEFTA, Chapter 3 of CUFTA or the CETA Protocol on Rules of Origin and Origin Procedures.
97.201(4) Authority to give notice of a decision made under paragraph 97.201(3)(b).
