Notice of initiation of anti-circumvention investigation: Container Chassis (CC 2024 AC)

The Canada Border Services Agency (CBSA) initiated an investigation on November 25, 2024, under the Special Import Measures Act, respecting the alleged circumvention from Vietnam of the Canadian International Trade Tribunal’s (CITT) finding issued on February 18, 2022 in Inquiry No. NQ-2021-005, respecting the dumping and subsidizing of container chassis from China. The investigation follows a complaint filed by Max-Atlas International Inc. (the complainant).

The complainant alleges that circumvention is occurring through assembly or completion of the goods in Vietnam, by means of insignificant process, using parts or components—that represent a major portion of the total cost of producing the like goods—originating in or exported from China.

The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s finding can be found on the CBSA’s Measures in Force.

The complainant stated that container chassis from Vietnam are like goods that meet the same product definition as the subject goods, except that they originate in or are exported from Vietnam.

The complainant alleges that the goods are assembled or completed in Vietnam by means of insignificant processes, using parts or components—that represent a major portion of the total cost of producing the like goods—originating in or exported from China.

The CBSA will investigate whether the imports are circumventing the CITT’s finding, and will make a decision within 180 days. If the CBSA finds that goods are circumventing the CITT’s findings, the CBSA will notify the CITT, and the CITT will amend its findings to extend anti-dumping or countervailing duties to the goods.

Additional information about the investigation will be available in a Statement of Reasons that will be available within 15 days.
