Notice of initiation of expiry review investigation: Dry wheat pasta (DWP 2023 ER)

On , the Canadian International Trade Tribunal (CITT), pursuant to subsection 76.03(1) of the Special Import Measures Act (SIMA), initiated an expiry review of its finding made on , in Inquiry No. NQ-2017-005, concerning the dumping and subsidizing of certain dry wheat pasta originating in or exported from the Republic of Türkiye.
As a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) has today initiated an expiry review investigation to determine, pursuant to paragraph 76.03(7)(a) of SIMA, whether the rescission of the finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. The CBSA will make a determination no later than , and will issue a Statement of reasons by .
The subject goods are defined as:
“All dry wheat-based pasta, not stuffed or otherwise prepared, and not containing more than two percent eggs, whether or not enriched, fortified, organic, whole wheat or containing milk or other ingredients, originating in or exported from the Republic of Turkey, excluding refrigerated, frozen or canned pasta.”

As part of its expiry review investigation, the CBSA has solicited responses to questionnaires from Canadian producers, importers, exporters/foreign producers and the Government of China.
