Customs Notice 24-40: Regulations Amending the Prescribed List of Prohibited Firearms

1. This notice is to advise interested parties that on , the Government of Canada announced a new amendment to the Classification Regulations. As a result of this change, additional firearms and their variants that were previously classified as non-restricted or restricted have now been re-classified as prohibited firearms.
2. A complete list of the prescribed prohibited firearms can be found on the Public Safety Canada website.
3. Please be advised that the Canada Border Services Agency (CBSA) will immediately begin prohibiting the importation of all firearms that are listed in the Regulations by individuals or businesses, unless an exemption is met.
4. When a resident declares a prohibited firearm that was newly acquired they will be provided with the option of abandoning or exporting the firearm.
5. Individuals currently outside of Canada with an affected firearm will be able to re-import the firearm but may be asked to provide proof, either by producing an export permit or an import permit from the country the individual was visiting.
6. The actions outlined above for residents also apply to Indigenous group members and sustenance hunters.
7. Non-residents cannot import prohibited firearms including the newly prohibited firearms. The non-resident will be offered the option to export or abandon the firearm.
8. A business, including motion picture, television, or theatrical companies, may only import prohibited firearms and devices if they have importation as a prescribed activity on their firearms business licence.
9. A business that does not hold a firearms business licence cannot import these goods. The business can export or abandon the items.
10. If the business chooses the export option, they must present a firearms business licence with the possession of or export of prohibited firearms and devices as a condition of the licence.
11. A business that chooses to export prohibited firearms or devices must present a firearms business licence and an export permit from Global Affairs Canada.
12. Exports of prohibited firearms are limited to countries found on the Automatic Firearms Country Control List.
13. If the firearms are not declared at the time of importation they may be seized.
14. The CBSA’s policy on the importation of prohibited firearms is available in Memorandum D19-13-2: Importing and Exporting Firearms, Weapons and Devices. This Memorandum will be revised to reflect the changes to the importation of the newly prohibited firearms.
