Terms of use

The ReportIn app allows people who are required to report to the Canada Border Services Agency (CBSA) to report without physically coming into a CBSA office. ReportIn confirms your identity by comparing a facial photo taken when you are reporting, with a facial photo that the CBSA has on file. ReportIn records and transmits your location when you report to the CBSA. and allows the CBSA to communicate with you via messages. It may also transmit your location at the request of the CBSA if you fail to report as required. ReportIn also allows CBSA to send you messages.

By selecting ‘I have read and agree to the Terms of Use’ below you are acknowledging that you understand the following Terms and Conditions for using the ReportIn app. You will not be able to use the app until you acknowledge the Terms and Conditions.

Your privacy

When using the app, your personal information is encrypted and transmitted securely to the CBSA. The CBSA securely stores the information you submit until it is no longer required for the purpose for which it was collected, or at the expiry of the retention period set by the Privacy Act and CBSA policy.

Collection of personal information by the CBSA is done in compliance with the Privacy Act, and under the authority of the Immigration and Refugee Protection Act (IRPA). Providing personal information to the CBSA may be necessary to comply with some conditions imposed by the Canada Border Services Agency, Immigration, Refugees and Citizenship Canada (IRCC) or the Immigration and Refugee Board (IRB).

The app will be collecting the following data:

Your personal information will be used, disclosed and destroyed as described in InfoSource record CBSA PPU 1801.

How your information is used and disclosed

The information collected and submitted via the app may be used for the following purposes:

  1. For monitoring and verifying compliance with conditions imposed by the Canada Border Services Agency (CBSA), Immigration, Refugees and Citizenship Canada (IRCC) or the Immigration and Refugee Board (IRB).
  2. To assist in any investigation into suspected non-compliance with one of the conditions imposed under the Immigration and Refugee Protection Act.
  3. To respond to messages sent via the app.
  4. To diagnose or fix technology problems.

The CBSA is responsible for monitoring compliance with conditions imposed by the CBSA, IRCC or the IRB. If using the app is one of the conditions imposed on you, you must accept to let the app transmit your personal information to the CBSA, which includes your facial photo and location information. If you refuse, the CBSA may consider that you have not met one of the conditions and take enforcement action that may include imposing new conditions or detention.

Personal information may also be used for program evaluation. In other limited and specific circumstances, personal information may be used and/or disclosed without consent in accordance with section 7 and subsection 8(2) of the Privacy Act.

Biometric information submitted will be used to improve the accuracy of the system. This includes using your facial photo biometric information to train machine learning algorithms. Demographic information such as your age, gender and country of birth may be used to analyze and evaluate the accuracy of machine learning algorithms. Personal identifiers such as your name and birthdate will not be shared or used for training the biometric algorithms. If you wish for your information to not be used to train biometric algorithms, you can opt out by contacting the CBSA office in charge of your file.

CBSA may share some limited information with a third-party service provider engaged to fulfill one of the purposes listed above. This may include sharing the device location to determine location error detection and sharing facial photos to complete the facial comparison process. Facial comparison results will be reviewed by the CBSA in all cases.

Your rights under the Privacy Act

In addition to protecting personal information, there is a right to request access to and request correction of one’s own personal information as provided for under the Privacy Act and to file a complaint with the Privacy Commissioner of Canada concerning the handling of your information.

ReportIn application permissions

If you are submitting information in the ReportIn mobile app, the app may ask for permission to access your device’s camera. The app needs to access your camera so your facial photos can be submitted to the CBSA.

Access to your phone’s device information and location is needed to allow CBSA to record your location at the time you submit your report and also if a CBSA officer is investigating a suspected failure to comply with one of the conditions imposed.

End user licence agreement

This end-user licence agreement (EULA) is a legal agreement between you, the end-user, in your capacity as an individual (hereinafter referred to as the “licensee”), and his Majesty the King in right of Canada as represented by the Minister of Public Safety (hereinafter referred to as “CBSA)

The licensee hereby agrees to adhere to the Terms and Conditions of this EULA. Downloading, installing or using the software by the licensee or a third party indicates that the user agrees to be bound by the Terms and Conditions below:

1 Grant of license

1.1 Upon the terms and conditions hereinafter set forth, CBSA hereby grants to you, the Licensee, a non-exclusive license to use the Software.

1.2 The Licensee shall not disclose, sell, sublicense, loan, transfer, reverse-engineer the Software, or otherwise assign any rights under this EULA to any third party.

2 Term

2.1 This EULA shall come into force upon the first instance that the Software is used by the Licensee or comes into the possession of the Licensee.

2.2 This EULA shall remain in force until terminated by a) CBSA as a result of the Licensee’s breach of this EULA or, b) the Licensee destroys all copies of the Software.

3 Title

3.1 Licensee agrees that the Software is and shall at all times remain the property of the CBSA. The Licensee shall have no right, title and interest therein or thereto, except as expressly set forth in this EULA.

4 Warranty and indemnity

4.1 The Software is licensed on an "AS IS" basis. CBSA makes no guarantees, representations, or warranties respecting the Software, either express or implied, arising by law or otherwise, including but not limited to effectiveness, completeness, accuracy, or fitness for a particular purpose.

4.2 CBSA shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the Licensee’s use or possession of the Software. CBSA shall not be liable in any way for loss of revenue or contracts, or any other consequential loss of any kind resulting from the Licensee’s use or possession of the Software.

4.3 The Licensee shall indemnify and defend CBSA, its employees, contractors, agents and suppliers, from and against all claims, demands, losses, damages, costs (including legal fees and costs on a substantial indemnity basis), actions, suits or proceedings brought by any third party, that are in any manner based upon, arising out of, or attributable to the use, possession, or performance of the Software by the Licensee.

5 Termination

5.1 If the Licensee breaches any obligation under this EULA and fails to remedy the breach within thirty (30) calendar days, the present EULA is deemed to be terminated immediately without any notice, and the Licensee agrees to immediately destroy all copies of the Software and related documentation.

6 Applicable law

6.1 This EULA shall be interpreted in accordance with the provincial or territorial laws in force in Ontario, Canada.
