Notice of scope ruling

Ottawa, August 14, 2020

The Canada Border Services Agency (CBSA), pursuant to subsection 66(1) of the Special Import Measures Act (SIMA), made a scope ruling with respect to the goods that were the subject of the application, namely Enerkem Inc.’s Specialized Prefabricated Process Units (SPPU).

On the basis of the information on the administrative record, consideration of the relevant factors contained in section 54.6 of the Special Import Measures Regulations and any other relevant factors, the CBSA made a scope ruling pursuant to subsection 66(1) of the SIMA that Enerkem Inc.’s SPPU are not subject to the Canadian International Trade Tribunal’s finding issued on June 26, 2020, in Inquiry No. NQ-2016-004R.
