Scope proceedings
Scope proceedings are conducted by the Canada Border Services Agency (CBSA) under the Special Import Measures Act (SIMA) to establish whether certain goods fall within the product description of an existing anti-dumping or countervailing measure. It is important to note that scope proceedings are intended to only clarify whether goods are subject to a finding and are not intended to exclude goods from the finding. Requests for product exclusions from the finding are the responsibility of the Canadian International Trade Tribunal (CITT).
Assessing a scope application
Each scope proceeding examines whether certain products are of the same description as goods to which an existing anti-dumping or countervailing measure applies. Each scope proceeding may include the following:
- a scope proceeding schedule
- a list of exhibits
- a list of counsel granted disclosure
- notices of initiation, termination or conclusion of scope proceeding
- statement of essential facts
- a scope ruling or amended scope ruling
- statements of reasons for scope ruling
