Conclusion of normal value review : Carbon steel fasteners (FAS 2023 UP3)

The Canada Border Services Agency (CBSA) has today concluded a normal value review (review) to determine normal values and export prices of certain carbon steel fasteners (fasteners) originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei) by Pro Power Co., Ltd. (Pro Power).
The review follows a request for re-determination filed by an importer and is part of the CBSA’s enforcement of the Canadian International Trade Tribunal’s (CITT) order issued on , respecting the dumping of fasteners originating in or exported from People’s Republic of China (China) and Chinese Taipei, and the subsidizing of such goods, originating in or exported from China, excluding fasteners specifically designed for application in the automotive or aerospace industry, in accordance with the Special Import Measures Act (SIMA).
The product definition and the applicable tariff classification numbers of the goods subject to the CITT’s order are contained in Appendix 1 (subject goods).
Period of Investigation
For this review, the Period of Investigation (POI) and the Profitability Analysis Period (PAP) were from to .
Normal Value Review Process
At the initiation of this review, on , the CBSA sent a Request for Information (RFI) to Pro Power in order to solicit information on the costs and selling prices of subject goods and like goods. The information was requested for purposes of determining normal values and export prices applicable to subject goods exported to Canada.
On , Pro Power provided a response to the Exporter RFIFootnote 1, which was considered incomplete. The CBSA sent a deficiency letterFootnote 2 to the exporter on July 4, 2023, and provided Pro Power until July 11, 2023 to submit a complete response. On July 11, 2023, Pro Power submitted more information in response to the RFIFootnote 3, although the response remained incomplete. On , the record for this normal value review was closed.
On , a case brief was filed on behalf of the importer.Footnote 4 Counsel for the importer submitted that Pro Power provided sufficient information to allow for the determination of the normal values and export prices.
There was no reply submission. The representations filed on behalf of the importer were given due consideration by the CBSA prior to the conclusion of this review.
Procedural Issues
The CBSA will normally not consider any new information submitted by participants subsequent to the closing of the record. However, in certain exceptional circumstances, it may be necessary to permit new information to be submitted. The CBSA considers a number of factors in deciding whether to accept new information submitted after the closing of the record including the availability of the information prior to the closing of the record and the relevance and materiality of the information.
With respect to this normal value review, Pro Power filed a case brief on August 23, 2023 in which it expanded on its response to the RFI. The exporter’s case brief, which did not provide replies to the importer’s case brief, was submitted one week after the scheduled deadline for case arguments. Furthermore, Pro Power’s case brief contained new information, which was submitted two weeks after the record was closed. The CBSA decided not to accept the submission after determining that the information submitted consisted of new information, which was available to be submitted before the close of the record, and that the information was not considered material with respect to the determination of normal values and export prices.
Normal Values
Further to this review, the information to determine the normal value for any of the goods under review was not provided or is insufficient. As a result, the normal values for Pro Power will be determined pursuant to a ministerial specification under section 29 of the SIMA by advancing the export price of the goods by 170 percent.
Importer Responsibility
Importers are reminded that it is their responsibility to calculate and declare their anti-dumping duty liability. If importers are using the services of a customs broker to clear importations, the brokerage firm should be advised that the goods are subject to SIMA measures and be provided with sufficient information necessary to clear the shipments. To determine their anti-dumping liability, importers should contact the exporter(s) to obtain the applicable normal values. For further information on this matter, refer to Memorandum D14-1-2, Disclosure of Normal Values, Export Prices, and Amounts of Subsidy Established under the Special Import Measures Act.
The Customs Act (Act) applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duties. As such, failure to pay the duties within the prescribed time will result in the application of the interest provisions of the Act.
