Concerning the termination of a dumping investigation with respect to
PULP-DEWATERING SCREW PRESSES, ASSEMBLED OR UNASSEMBLED, ORIGINATING IN OR EXPORTED FROM NORWAY AND PRODUCED BY OR ON BEHALF OF KVÆRNER PULPING A.S., ITS AFFILIATES, SUCCESSORS AND ASSIGNS.
Pursuant to paragraph 35(2)(a) of the Special Import Measures Act, the Commissioner of Customs and Revenue has today terminated the dumping investigation with respect to pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kværner Pulping a.s., its affiliates, successors and assigns.

On November 27, 2000, the Commissioner of Customs and Revenue (Commissioner) initiated an investigation into the alleged injurious dumping of pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kværner Pulping a.s., its affiliates, successors and assigns. The investigation was initiated in response to a complaint filed by Optimum Filtration Inc. of Baie d'Urfé, Quebec.
On receiving notice of the investigation, the Canadian International Trade Tribunal started its preliminary injury inquiry.
Following the analysis of information provided to the Canada Customs and Revenue Agency (CCRA) in response to Requests for Information, the Commissioner is satisfied that there is insufficient evidence of dumping to justify proceeding with the investigation. Accordingly, the Commissioner has terminated the dumping investigation in accordance with paragraph 35(2)(a) of the Special Import Measures Act (SIMA).
The complainant, Optimum Filtration Inc. (Optimum) is the only producer of pulp-dewatering screw presses in Canada. The company is located at 20201 Clark Graham, Baie d'Urfé, Quebec H9X 3T5.
The following company was named as the exporter of the allegedly dumped goods:

The following possible importer, that is associated with the exporter, was identified as the importer of record of the allegedly dumped goods:
Kværner Pulping Inc.,
2995 Le Corbusier St.
Laval, Quebec
H7L 3M3
Two pulp mills in Canada were also identified as purchasers and potential importers of subject goods at the initiation of the investigation.
The complaint relating to the investigation was filed on October 23, 2000, following a number of discussions and meetings with the CCRA. On November 9, 2000, the CCRA informed Optimum that its complaint was properly documented and, at the same time, notified the Government of Norway that a properly documented complaint had been filed.
The investigation into the alleged injurious dumping of the subject pulp-dewatering screw presses was initiated on November 27, 2000.
The subject goods were defined as:
"Pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kværner Pulping a.s., its affiliates, successors and assigns."

In conducting its investigation, the CCRA requested information from the named exporter, Kværner Pulping a.s. and the three possible importers. Responses were received from all four parties. Subject goods sold to or imported into Canada during the period of January 1, 2000 to September 30, 2000 were under investigation.
The investigation revealed that there were no subject goods as defined above that were sold to or imported into Canada during the period of investigation. At the time the goods entered Canada they were improperly declared on customs documentation as originating in and exported from Norway. However, information was received by the CCRA that demonstrated that the pulp-dewatering screw presses that were sold to or exported to Canada by Kværner Pulping a.s. during the period of investigation originated in and were exported from countries other than Norway.
The Commissioner is satisfied that there is insufficient evidence of dumping to justify proceeding with the investigation in accordance with subparagraph 35(1)(a)(i) of SIMA.
Pursuant to paragraph 35(2)(a) of SIMA, the Commissioner has, on this date, caused the investigation to be terminated with respect to pulp-dewatering screw presses, assembled or unassembled, originating in or exported from Norway and produced by or on behalf of Kværner Pulping a.s., its affiliates, successors and assigns.
Notice of this termination of investigation is being published in the Canada Gazette pursuant to subparagraph 35(2)(a)(ii) of the SIMA.
